When One Says "I'm done" and the Other says "Let's try":  Discernment Counseling for mixed-agenda couples (6 CEUs)

Discernment Counseling - Ethics Training (3 CEUs)

Discernment counseling is a short-term counseling approach (1-5 sessions) developed to cater to the unique needs of mixed-agenda couples (one leaning into and one leaning out of the relationship). The goal of discernment counseling is to help couples gain greater clarity and confidence in their decision making about the future of their marriage. Through a combination of couple and individual time, each partner develops a personal agenda for change. Further, they discover what it might take to either restore the relationship back to health, divorce in a healthy way, or make no change at all.

Learning Objectives:

  1. Be able to identify “mixed-agenda” couples in clinical practice
  2. Apply basic tenets of discernment counseling to engage these couples clinically
  3. Understand the ethical dilemmas in treating couples with commitment uncertainty/divorce ideation

Keynote Presenter: Dr. Steven Harris

Steve Harris

Steven M. Harris, PhD, LMFT is Professor and Director of the Couple and Family Therapy Program at the University of Minnesota.  He has been practicing as a marriage and family therapist for over 29 years.  He also serves as the Associate Director of the Minnesota Couples on the Brink Project.  He is involved in a variety of research projects including with the National Divorce Decision-Making Project and in clinical practice with couples on the brink of divorce. He is the author of over 65 peer-reviewed articles and book chapters and the co-author of "Seven Letters That Will Bring You Closer to Your College Student" and "Should I Try to Work it Out?" He lives in the Twin Cities of Minnesota and enjoys the outdoors, college basketball, and Tabasco.

 

An Introduction To The Collaborative Divorce Process (3 CEUs)

Alan Bouwkamp with another attorney, a mental health professional, and a financial expert will present an introduction to the Collaborative Divorce Process.  Collaborative Practice is an out-of-court inter-disciplinary process for resolving disputes respectfully. It is a non-adversarial approach that utilizes specially-trained professionals to help participants negotiate a mutually acceptable resolution of differences by creating shared solutions, acknowledging the highest interests and priorities of all, maintaining open communication and information-sharing, and negotiating a mutually acceptable agreement, without going to court. This presentation will address the differences between the Collaborate Practice from traditional litigation, the benefits it offers to the parties to a divorce and their children, introduce you to the roles of the team of professionals, and explain the “nuts and bolts” of the process. We will address how the Collaborative Practice can provide a safe, supportive, and respectful environment where divorcing parties are empowered to productively resolve divorce issues based on their goals and interests, while seeking to minimize damage to their children, families, and relationships.

Learning Objectives:

  1. Participants will understand the differences between the collaborative divorce process and the traditional adversarial method of litigating a divorce through the court system.
  2. Participants will learn the procedural and process aspects of collaborative divorce and how they are designed to support and engage divorcing spouses.
  3. Participants will understand the interdisciplinary nature of the collaborative process and the roles of collaboratively trained lawyers, mental health professionals, and financial experts in it.
  4. Participants will learn how the collaborative process promotes and supports the resolution of divorce in a civil, non-adversarial, and respectful manner focusing on the parties’ goals and the interests of the family.

Alan Bouwkamp

ALAN A. BOUWKAMP is a partner in the firm of Becker Bouwkamp Walker, PC in Indianapolis, Indiana, where he practices in the areas of family law and general litigation issues. Mr. Bouwkamp received a B.A. Degree in 1984 from Indiana University and his Juris Doctorate degree, cum laude, in 1990 from Indiana University School of Law-Indianapolis. Mr. Bouwkamp has practiced extensively before trial courts throughout Indiana, the Indiana Court of Appeals, and has argued before the Indiana Supreme Court. Mr. Bouwkamp has lectured extensively on issues such as life after divorce, child custody and shared parenting, child abuse, and general family law. He has had an AV Preeminent® rating through Martindale-Hubbell® for more than 16 years, is recognized as an Indiana Super Lawyer, 2020, and is a Distinguished Fellow of the Indianapolis Bar Foundation.

He is a member of the Indianapolis, Hamilton County, and Indiana State Bar Associations, a member of Grievance Committee B of the Indianapolis Bar Association, a member of the International Academy of Collaborative Professionals, and the Central Indiana Association of Collaborative Professionals. Mr. Bouwkamp is also a member of the Indiana Chapter and National Association of Family and Conciliation Courts. He is a member of Collaborative Solutions, Inc., an interdisciplinary Collaborative Law practice group working together to help couples avoid the uncertain outcome of court.
